Terms and Conditions

Article 1 - Purpose

These Terms and Conditions govern the sale of products on the website brushandsmile.fr, operated by Brush & Smile, sole proprietor based in France.

By placing an order, you accept these Terms and Conditions without reservation.

Article 2 - Products

The products offered for sale are creative painting kits for children, including figurines, paints, and accessories.

Product photos are for illustration purposes only. Minor variations in appearance may occur.

Recommended age: Our kits are designed for children aged 4-5 and up. Adult supervision is recommended for younger children.

Article 3 - Prices

Prices are displayed in euros (€) and include all applicable taxes. VAT is not applicable under Article 293 B of the French Tax Code (sole proprietor status).

Brush & Smile reserves the right to modify prices at any time. Products are billed at the price in effect at the time of order confirmation.

Article 4 - Ordering

To place an order, the buyer must:

1. Select products and add them to the cart
2. Confirm the cart contents
3. Enter delivery address details
4. Choose a delivery method
5. Complete secure payment

Order confirmation constitutes acceptance of these Terms and Conditions.

Article 5 - Payment

Payment is made securely online by credit card or through the payment solutions offered (PayPal, Apple Pay, etc.).

Orders are confirmed upon payment validation.

Article 6 - Delivery

Processing time:

• Preparation: 48 business hours
• Delivery to France: 2-3 business days (Colissimo)
• Delivery to Belgium/Luxembourg: 3-5 business days
• Delivery to Switzerland: 5-7 business days

Shipping costs:

• France: Free for orders over €35, otherwise €4.90
• Belgium/Luxembourg: €8.90
• Switzerland: €12.90 (customs fees, if any, are the recipient's responsibility)

Article 7 - Right of Withdrawal

In accordance with consumer law, you have 14 days from receipt of your order to exercise your right of withdrawal, without having to justify any reason.

Conditions:

• Products must be returned in their original packaging, unopened and in perfect condition
• Return shipping costs are the buyer's responsibility
• Refunds will be processed within 14 days of receiving the returned items

Article 8 - Warranty and Claims

In case of a defective or damaged product upon receipt:

• Contact us within 48 hours with a photo of the issue
• We will send you a replacement product free of charge

Article 9 - Liability

Brush & Smile cannot be held liable for damages resulting from improper use of products.

Our paints are CE certified and comply with European EN71 toy safety standards.

Article 10 - Personal Data

Information collected is necessary for order processing. It is handled in accordance with our Privacy Policy and GDPR regulations.

Article 11 - Disputes

These Terms and Conditions are governed by French law.

In case of dispute, an amicable solution will be sought before any legal action. Failing that, French courts shall have jurisdiction.
